1. PURPOSE

The general terms of sale described hereinafter, detail the rights and obligations of the CASALIL SARL company, "La Maison Pernoise" brand, located:

And, of the internet customer (hereinafter named « CUSTOMER ») in connection with the sale of its products on the site http://www.lamaisonpernoise.com.

The fact of placing order with La Maison Pernoise implies the unreserved adherence for the CUSTOMER of the current general terms of sale.

2. ORDER

All order shall be charged in accordance with the rate appearing on the registration date of the order by La Maison Pernoise. The information given by the CUSTOMER during the execution of the order is binding on them: in the event of error, La Maison Pernoise could not be held responsible for the possible inability, to deliver the order. Either way, the validation of the order is worth a signature and express acceptance of any operations made on the website.

3. PRICES

The prices of the products that are sold, are those in effect on the day of the order. They are expressed in Euros and are all taxes included, without delivery costs which are calculated based on the amount of the order. La Maison Pernoise reserves the right to modify or change the products and its prices at any time without prior notice. However it agrees to charge the merchandise that has been ordered at the prices appearing during the registration of the order.

4. TERMS OF PAYMENT

Orders must be paid before shipping by:

- Credit card (secure online payment)
- Cheque

The minimal amount to confirm an order on the web site www.lamaisonpernoise.com is established at 10€.

5. DELIVERY- COLLECTION

• The CUSTOMER has the possibility to collect the merchandise in "Click & Collect". In this case you must mention it in the order information, and La Maison Pernoise will convey the collection date.

Any reasonable delay in delivering the products shall not entitle the buyer to cancel the order nor for compensation for damages. The CUSTOMER shall ensure that the delivery being delivered is in accordance with what is expected on the order. When the order is delivered, the CUSTOMER shall be responsible for verifying the good condition of the delivered products by opening the order in front of the delivery person; otherwise, no transportation guarantee shall be applied. Moreover, the indicated delays shall be suspended automatically by the occurrence of any event which is independent from the will and/or control of La Maison Pernoise and resulting in the delay of the delivery and, notably, in case of supply disruption, of delay or non-delivery by any supplier of La Maison Pernoise, of stockout of one or several products involved as in any case of force majeure. The eventual information errors conveyed by the CUSTOMER during the execution of the order (addressee’s details) shall not, in any circumstances, be the accountability of La Maison Pernoise in case of non-delivery of the merchandise. In case of delivery in the French D.O.M-T.O.M or abroad, the entirety of the costs is carried by the CUSTOMER.

6. RETURNS

Our products travel at the own risk of the CUSTOMER. Moreover, any complaints for visible defect of the products, regardless of the motive, shall be addressed to La Maison Pernoise by a registered letter with a request for acknowledgement of receipt, within the eight days following the delivery of the ordered products, the CUSTOMER being deemed to this deadline term, to have accepted unreservedly. In the event of an order error by the CUSTOMER concerning the products reference, La Maison Pernoise reserves the right to accept to take the products in question back. In the event of acceptance, a refund or exchange shall be established after observation by La Maison Pernoise of the good condition of the returned products. The delivery and forwarding costs remain in this case at the charge of the CUSTOMER. In the event of an error by La Maison Pernoise, the products shall be exchanged within eight days. The delivery and forwarding costs shall be at the charge of La Maison Pernoise. It is the CUSTOMER‘s responsibility to provide to La Maison Pernoise any needed justification for their complaint. In cases in which CUSTOMER‘s complaint was accepted by the Company, the latter shall proceed, at its choice and according to the stock availability, to an exchange or a return of the products, any return establishing a corresponding credit note.

7. WITHDRAWAL CLAUSE

The CUSTOMER has, under Article 221-18 of the French Consumer Code, a period of 14 clear days following the delivery date to exercise their right of withdrawal. If this period of 14 days normally expires on a Saturday, a Sunday or a bank holiday or nonworking day, it is extended until the first following working day. The CUSTOMER shall contact La Maison Pernoise of their intention to return the products by e-mail before the expiry of the period of 14 days. La Maison Pernoise shall accept the exchange and the refund of the products only if all the following conditions are met:
a) The return of the product(s) shall be made within the time limits specified in the first paragraph of this article, the date appearing on the delivery note evidencing the date of delivery,
b) The products shall be return in their original packing and in perfect condition of resale to be refundable and exchangeable,
c) Any return shall be, beforehand, authorised by La Maison Pernoise in a written form.
Any product that has been damaged, or whose original packing has been deteriorated, shall be neither refunded nor exchanged. In particular, a product whose packing has been deteriorated during the return shall not be accepted. La Maison Pernoise reserves the right to determine in good faith if all the conditions have been met. In cases of exchange or refund, the CUSTOMER shall send back the product(s) at their own expense in its intact original packing, with all the eventual accessories, the instruction guides and documentation, to the following address:

The refund, excluding delivery costs, will be made directly on the credit card used for payment or by bank transfer within a maximum of 14 days after the sending of the confirmation of the product’s receipt to the customer. In cases of partial cancellation of an order, La Maison Pernoise shall keep the delivery costs’ profit corresponding to the delivered products.

8. RETENTION OF TITLE

The ownership transfer of the delivered products to the CUSTOMER only takes place after the full payment of their prices and its accessories under article 1853 of the French Civil Code, under the provisions of the 12.05.1980 law. During the waiting period until the full payment of the price, the risk of loss, theft or destruction are at the charge of the CUSTOMER.

9. FORCE MAJEURE

La Maison Pernoise's liability could not be implemented if the non-performance or the delay in the execution of one of its obligations described in the present general terms of sale result from a case of absolute necessity. For this reason, force majeure includes any unforeseeable, unstoppable and external event in the sense of article 1148 of the French Civil Code.

10. LIABILITY – WARRANTY

La Maison Pernoise shall not be held liable for any damage of any kind, whether material, immaterial or physical, which may result from a misuse of the marketed products or of their abnormal usage. La Maison Pernoise shall not be held liable for any inconvenience or damages due to the use of the Internet network and totally external from the diligences and precautions taken by La Maison Pernoise. Particularly, any disruption in the provision of service, or any external intrusion or the presence of a computer virus, shall not engage the liability of La Maison Pernoise. The CUSTOMER benefits from the legal guarantee of eviction and hidden defects in accordance with the terms of Article 1625 and following of the French Civil Code.

11. DISPUTES

Any dispute relating to the interpretation and execution of the present general terms of sale is subjected to the French right. In the absence of friendly resolution, the dispute shall be submitted to the competent court.

12. INTELLECTUAL PROPERTY

The Website and all the elements that comprise it are the exclusive property of La Maison Pernoise. The CUSTOMER refrains to copy or download all or any part of the website content, except with prior written autorisation given by La Maison Pernoise.
