1. PURPOSE
The general terms and conditions of sale described below set out the rights and obligations of the company CASALIL SARL, trading as "La Maison Pernoise", with its registered office at:

And of the online customer (hereinafter referred to as the "CUSTOMER") in connection with the sale of its products on the website http://www.lamaisonpernoise.com.
Placing an order with La Maison Pernoise implies the CUSTOMER's unreserved acceptance of these general terms and conditions of sale.
2. ORDER
Any order will be invoiced in accordance with the price shown on the website on the date the order is recorded by La Maison Pernoise. The information provided by the CUSTOMER when placing the order is binding upon them: in the event of an error, La Maison Pernoise cannot be held responsible for any inability to deliver the product. In all cases, validation of the order constitutes a signature and express acceptance of all the transactions carried out on the website.
3. PRICE
The prices of the goods sold are those in force on the day the order is placed. They are expressed in Euros and are inclusive of all taxes, excluding delivery charges, which are calculated according to the amount of the order. La Maison Pernoise reserves the right to modify or change the products and prices offered at any time without prior notice. However, it undertakes to invoice the goods ordered at the prices indicated when the order was recorded.
4. PAYMENT TERMS
Orders must be paid for before shipping by:
- Bank card (secure online payment)
- Cheque
The minimum amount required to validate an order on the website www.lamaisonpernoise.com is set at €10.
5. DELIVERY - COLLECTION
- The CUSTOMER has the option of collecting the goods using the "Store Pickup" method. In this case, this should be mentioned in the order information, and La Maison Pernoise will communicate the possible collection day.

Any reasonable delay in the delivery of the products may not give rise to any cancellation of the order or to damages for the benefit of the buyer. The CUSTOMER must ensure that the delivery handed over to them conforms to that specified on the order. Upon receipt of their parcel, the CUSTOMER is responsible for checking the good condition of the products delivered by opening the parcel in front of the carrier; failing which, no transport guarantee may be applicable. Furthermore, the indicated time frames will be automatically suspended by the occurrence of any event beyond the will and/or control of La Maison Pernoise and having the effect of delaying delivery, in particular in the event of a supply shortage, delay or failure to deliver by any supplier of La Maison Pernoise, a stock shortage of the product(s) in question, or in any case of force majeure. Any errors in the information provided by the CUSTOMER when placing the order (recipient's details) cannot under any circumstances be the responsibility of La Maison Pernoise in the event of non-delivery of the goods. In the case of delivery to the French overseas departments and territories (D.O.M-T.O.M) or abroad, all charges are borne by the CUSTOMER.
6. RETURNS
Our products travel at the CUSTOMER's own risk. Furthermore, any complaint regarding an apparent defect in the products, whatever the reason, must be sent to La Maison Pernoise by registered letter with acknowledgement of receipt, within eight days of receiving the products ordered; at the end of this period, the CUSTOMER is deemed to have accepted them without reservation. In the event of an ordering error by the CUSTOMER regarding the product reference, La Maison Pernoise reserves the right to accept the return of the products in question. If accepted, a refund or exchange will be issued after La Maison Pernoise has confirmed the good condition of the returned products. In this case, the shipping and return shipping costs remain the responsibility of the CUSTOMER. In the event of an error by La Maison Pernoise, the products will be exchanged within eight days. The shipping and return shipping costs will be borne by La Maison Pernoise. It is the CUSTOMER's responsibility to provide La Maison Pernoise with any documentation necessary to support their complaint. Should the CUSTOMER's complaint be accepted by the Company, the latter will proceed, at its discretion and depending on available stock, to an exchange or a return of the returned products, with any return giving rise to the issuing of a corresponding credit note.
7. RIGHT OF WITHDRAWAL
In accordance with Article 221-18 of the French Consumer Code, the CUSTOMER has a period of 14 clear days to exercise their right of withdrawal. If this 14-day period would normally expire on a Saturday, a Sunday or a public or non-working holiday, it is extended until the next working day. The CUSTOMER will inform La Maison Pernoise of their intention to return the products by email before the expiry of the 14-day period. However, La Maison Pernoise will only accept the exchange and refund of the products if all of the following conditions are met:
a) The return of the product(s) must be carried out within the time limits prescribed in the first paragraph of this article, the date shown on the delivery note serving as proof of the delivery date,
b) The products must be returned in their original packaging and in perfect resalable condition in order to be refundable and exchangeable,
c) Any return must be authorised in advance by La Maison Pernoise in writing.
Any product that has been damaged, or whose original packaging has been deteriorated, will be neither refunded nor exchanged. In particular, a product whose packaging has been deteriorated during the return will not be accepted. La Maison Pernoise reserves the right to determine in good faith whether all of these conditions are met.
In the event of an exchange or refund, the CUSTOMER must return the product at their own expense in its intact original packaging, together with any accessories, instruction manuals and documentation, to the following address:

The refund, excluding shipping costs, will be made directly to the bank card used for payment or by bank transfer within a maximum of 14 days after sending confirmation of receipt of the product to the customer. In the event of partial cancellation of an order, La Maison Pernoise will retain the benefit of the shipping costs corresponding to the products delivered. Beyond the legal period of 14 days, the refund will be made only in the form of a credit note.
8. RETENTION OF TITLE
The transfer of ownership of the products delivered to the CUSTOMER does not take place until full payment of their price and ancillary costs has been made by the CUSTOMER, in accordance with Article 1853 of the French Civil Code pursuant to the provisions of the Act of 12.05.1980. During the period running until full payment of the price, the risks of loss, theft or destruction are borne by the CUSTOMER.
9. FORCE MAJEURE
La Maison Pernoise cannot be held liable if the non-performance or delay in the performance of any of its obligations described in these general terms and conditions of sale results from a case of force majeure. In this respect, force majeure is understood to mean any external, unforeseeable and irresistible event within the meaning of Article 1148 of the French Civil Code.
10. LIABILITY - WARRANTY
La Maison Pernoise cannot be held responsible for damages of any kind, whether material, immaterial or bodily, which may result from the misuse of the products marketed or from their abnormal use. La Maison Pernoise cannot be held liable for any inconvenience or damage inherent in the use of the internet network and entirely beyond the care and precautions taken by La Maison Pernoise. In particular, any disruption in the provision of the service, or any external intrusion or presence of a computer virus, cannot engage the liability of La Maison Pernoise. The CUSTOMER benefits from the legal warranty against eviction and hidden defects in accordance with the terms of Article 1625 et seq. of the French Civil Code.
11. DISPUTES
Any dispute relating to the interpretation and performance of these general terms and conditions of sale is subject to French law. In the absence of an amicable resolution, the dispute will be brought before the competent court.
12. INTELLECTUAL PROPERTY
The Site and all the elements comprising it are the exclusive property of La Maison Pernoise. The CUSTOMER is prohibited from copying or downloading all or part of the content of the site, except with the prior written authorisation of La Maison Pernoise.
